Use of the website www.evmt.fr implies full and unreserved acceptance of the general terms of use described below. These terms of use may be amended or supplemented at any time; users of www.evmt.fr are therefore invited to consult them regularly.

This website is normally accessible to users at all times. EVMT may nevertheless decide to interrupt access for technical maintenance, in which case it will endeavour to notify users in advance of the dates and times of the work.

The website www.evmt.fr is updated regularly by Jérôme Ogor. Likewise, this legal notice may be amended at any time: it is nonetheless binding on users, who are invited to refer to it as often as possible in order to stay informed.

3. Description of the services provided

The purpose of the website www.evmt.fr is to provide information about all of the company’s activities.

EVMT endeavours to provide information on www.evmt.fr that is as accurate as possible. However, it cannot be held liable for omissions, inaccuracies or shortcomings in updating the content, whether caused by EVMT itself or by third-party partners supplying that information.

All information shown on www.evmt.fr is provided for guidance only and is subject to change. Furthermore, the information appearing on www.evmt.fr is not exhaustive. It is provided subject to any changes made since it was published online.

4. Contractual limitations regarding technical data

The website uses JavaScript technology.

The website cannot be held liable for any material damage arising from use of the site. In addition, users of the site undertake to access it using recent, virus-free equipment and an up-to-date, latest-generation browser.

5. Intellectual property and infringement

EVMT owns the intellectual property rights, or holds the usage rights, to all items accessible on the website, including but not limited to texts, images, graphics, logos, icons, sounds and software.

Any reproduction, representation, modification, publication or adaptation of all or part of the items on the website, by whatever means or process, is prohibited without the prior written permission of EVMT.

Any unauthorised use of the website or of any of the items it contains will be deemed to constitute infringement and prosecuted in accordance with Articles L.335-2 et seq. of the French Intellectual Property Code.

6. Limitations of liability

EVMT cannot be held liable for direct or indirect damage caused to the user’s equipment when accessing www.evmt.fr and resulting either from the use of equipment that does not meet the specifications set out in point 4, or from the appearance of a bug or an incompatibility.

EVMT may not be held liable either for indirect damage (such as loss of business or loss of opportunity) arising from the use of www.evmt.fr.

Interactive areas (the option to ask questions via the contact section) are available to users. EVMT reserves the right to delete, without prior notice, any content posted in this area that breaches applicable French law, in particular the provisions on data protection. Where applicable, EVMT also reserves the right to hold the user civilly and/or criminally liable, in particular in the case of racist, insulting, defamatory or pornographic messages, in whatever medium (text, photograph, etc.).

7. Management of personal data

In France, personal data is protected in particular by Act No. 78-87 of 6 January 1978, Act No. 2004-801 of 6 August 2004, Article L. 226-13 of the French Criminal Code and the European Directive of 24 October 1995.

When using www.evmt.fr, the following data may be collected: the URL of the links through which the user accessed www.evmt.fr, the user’s internet service provider and the user’s Internet Protocol (IP) address.

In any event, EVMT only collects personal information about the user for the purposes of certain services offered by www.evmt.fr. The user provides this information knowingly, in particular when entering it themselves. Users of www.evmt.fr are then informed whether or not they are required to provide this information.

In accordance with Articles 38 et seq. of Act No. 78-17 of 6 January 1978 on information technology, data files and civil liberties, every user has the right to access, rectify and object to personal data concerning them, by submitting a written and signed request accompanied by a copy of an identity document bearing the holder’s signature, and specifying the address to which the reply should be sent.

No personal information about users of www.evmt.fr is published without their knowledge, exchanged, transferred, assigned or sold on any medium whatsoever to third parties. Only in the event of the acquisition of EVMT and its rights would such information be transferred to the potential buyer, who would in turn be bound by the same obligation to store and amend the data with regard to users of www.evmt.fr.

The website is not registered with the CNIL, as it does not collect personal information.

Databases are protected by the provisions of the Act of 1 July 1998 transposing Directive 96/9 of 11 March 1996 on the legal protection of databases.

The data concerned is as follows:

The data provided is stored solely in Mr Jérôme OGOR’s mailbox and in an Excel file on Mr Jérôme OGOR’s computer. The devices on which this data can be accessed (mobile phones and computers) are password-protected.
